Tax Partner Discusses Practice Challenges and Code Reforms
Matthew Donnelly of Kirkland & Ellis outlines current tax practice issues and proposed code changes.
The Brief
- Tax practitioners face compressed deal timelines and challenges in training new lawyers.
- Litigation over the 'limited partner' exception under SECA creates regulatory uncertainty.
- Donnelly suggests removing complex and outdated tax code provisions.
Matthew J. Donnelly, a tax partner at Kirkland & Ellis, discussed current challenges facing tax professionals. He noted that deal timelines are becoming more compressed, and clients expect advisers to leverage artificial intelligence and other technologies to improve efficiency.
Despite these advancements, Donnelly emphasized that the quality of legal advice must remain high. He also highlighted difficulties in developing young lawyers, as new practitioners are learning in a different environment than their supervisors.
Donnelly expressed concern over litigation surrounding the 'limited partner' exception under the Self-Employment Contributions Act. He stated that this approach introduces uncertainty for taxpayers seeking legal certainty, potentially leading to retroactive application of judicial decisions.
In terms of professional development, Donnelly stressed the importance of cultivating friendships and mentors. He noted that learning in isolation is difficult and that strong professional relationships significantly enhance one’s career.
When asked about tax code reforms, Donnelly suggested removing complex and outdated rules. He specifically mentioned the anti-churning rules under Section 197(f)(9) as a priority due to recent experience with them.
Donnelly also shared that he recently served on a jury in a criminal trial where a guilty verdict was reached. He noted the defendant, who represented himself, outran police but later dropped his wallet, leading to his arrest.
