Seattle's Rent Rules Spark $39M Housing Investment Collapse
A Seattle court ruled that city rent regulations may have led to a $39 million affordable housing project's financial downfall.
The Brief
- Seattle's rental rules led to a 254-unit affordable housing complex entering receivership.
- Owners claim city regulations caused rent collections to drop from 93.9% to 44.1%.
- The case could influence similar disputes in other cities.
The Washington Court of Appeals ruled that GRE Downtowner LLC can proceed with claims that Seattle's rental regulations amounted to an unconstitutional taking of private property.
GRE Downtowner, the company behind the Addison on Fourth affordable housing development, alleges that city ordinances, including requirements to accommodate additional occupants without landlord consent, caused significant financial losses.
The development operated under the federal Low-Income Housing Tax Credit program, which offers tax incentives to private investors in exchange for providing rent-restricted apartments to lower-income residents.
According to court filings, GRE's investment initially generated positive cash flow from 2015 through 2018, but rent collections fell sharply as Seattle enacted a series of restrictive ordinances.
The financial decline led to a mortgage default in January 2026, prompting a federal judge to appoint a receiver to take control of the property.
GRE's lawsuit seeks compensation under inverse condemnation, arguing that Seattle's regulations effectively damaged its property without just compensation.
