The Brief

  • Advocate General’s Office requests replies from governor, speaker, and officials on petitions against emergency and governor’s rule.
  • Petitions argue emergency and governor’s rule are unconstitutional and exceed federal authority.
  • Court to hear petitions on November 10, with responses due by November 7.

The Peshawar High Court has directed the governor, chief secretary, provincial assembly speaker, and Home and Tribal Affairs Department secretary to submit their comments and reports on petitions challenging the imposition of emergency and governor’s rule in parts of Khyber-Pakhtunkhwa.

The petitions, filed by PTI Chairman Barrister Gohar Ali Khan and others, claim that the use of emergency and governor’s rule is unconstitutional and illegal, as the situation in the province was not beyond the control of the provincial government.

Petitioners argue that the federal government overstepped its constitutional authority by imposing these measures, which effectively removed the powers of the elected provincial government and its representatives.

The petitions further state that governor’s rule can only be imposed in exceptional circumstances when the provincial government itself recommends such action, and that the invocation of Article 245 to deploy armed forces was unconstitutional.

The court has ordered all relevant officials to submit their reports through Grade 17 officers by November 7, though questions remain about how the provincial assembly speaker, currently in protective custody, will provide his response.

The high court is set to take up the petitions for further hearing on November 10.
