The Brief

  • Erin Patterson was convicted of murdering her in-laws and attempting to kill another relative in 2023.
  • Appeal court ruled her life sentence with a 33-year non-parole period was too lenient.
  • Patterson's legal team argued trial integrity was compromised by evidence and procedural issues.

Erin Patterson, 5, has been denied an appeal to overturn her murder convictions and has been ordered to remain in prison for life.

The Victoria Court of Appeal rejected all seven grounds of Patterson's appeal, ruling her sentence was insufficient and her release was inappropriate.

Patterson was found guilty of murdering her in-laws, Don and Gail Patterson, and Gail's sister Heather Wilkinson, by serving them a meal laced with death cap mushrooms.

She was also convicted of attempting to kill Heather's husband, Ian Wilkinson, who survived after being hospitalized for weeks following the poisoning.

Patterson's legal team argued that a hotel booking error placed the jury, prosecution, key witness, and media in the same location, undermining the trial's fairness.

They also claimed certain evidence, such as cell tower data and Facebook posts, was irrelevant and prejudicial, while other evidence was improperly excluded.

The court rejected these arguments, stating the case involved 'extraordinarily cold and calculated' criminality that required a severe sentence.

Patterson now has 28 days to decide whether to seek further review of her case at the High Court of Australia.
